These terms of use govern the use of the CERVEZA PICUDO websites and mobile applications (together, the “Platforms”). In these Terms of Use, the term CERVEZA PICUDO (and “we”, “us” and “our”) refers to the main office of CERVEZA PICUDO located at the registered address stated above and its affiliates.

You may download an electronic copy or print a copy of the material offered through the Platforms of CERVEZA PICUDO on your mobile device, for your own use and exclusively for non-commercial, educational, private or household purposes, provided that notices of ownership, especially notices of intellectual property rights (©) and trademarks (™), remain intact and are not modified, removed or changed. Unless otherwise indicated, you must understand that everything you can see or read on the Platforms (such as images, photographs, including any person who may appear in the photographs, illustrations, icons, text, video clips, music and written materials (“CERVEZA PICUDO Material”)) is protected, among other regulations, by those relating to intellectual property rights, designs and trademarks, as well as by the provisions of international treaties and the national legislation of all countries.
You are not authorized to sell, reproduce, distribute, communicate, modify, show, publicly display, disclose or otherwise create derivative or second-hand works based on CERVEZA PICUDO Material, nor to use that material in any way for public or commercial purposes. Likewise, CERVEZA PICUDO Material may not be shown or communicated on any other platform, in any networked computing environment, or on any other digital platform for any purpose. In the event of a breach of these Terms of Use, your authorization to use CERVEZA PICUDO Material will end immediately, and you must immediately destroy any copies made of CERVEZA PICUDO Material.
Unsolicited submissions and communications.
This section refers to communications sent to CERVEZA PICUDO. It does not refer to the communication of personal information to CERVEZA PICUDO in connection with customer inquiries, the use of services, or the purchase of products by phone or through the Platform. Those matters are governed by the rules set out in the Privacy Policy.
Any unsolicited communication or material that you send to CERVEZA PICUDO through the Platforms or social media, by email or otherwise, including, without limitation, any data, questions or answers, comments, suggestions or the like, will be treated by CERVEZA PICUDO as non-confidential and not protected by intellectual property rights. By sending communications to CERVEZA PICUDO, you automatically grant CERVEZA PICUDO a worldwide, royalty-free, perpetual, irrevocable and non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, exhibit and display those communications, individually or as part of other works, in any format, medium or technology known now or developed later, as well as to grant sublicenses of those rights to any persons. Everything you send may be used by CERVEZA PICUDO and its affiliated companies for any purpose, including, without limitation, for reproduction, dissemination, transmission, publication and broadcasting; or for the development, manufacture and marketing of products using that information.
Furthermore, CERVEZA PICUDO enjoys a national reputation for craft beer brewing. To that end, it has its own sources of creativity, namely highly qualified brewing teams who conceive and perfect the creations of CERVEZA PICUDO. As a consequence, CERVEZA PICUDO cannot accept collaboration proposals that it has not requested. In this regard, CERVEZA PICUDO may already be working on similar ideas and/or creations. Users are therefore informed that CERVEZA PICUDO is not interested in receiving ideas or other proposals about creations.
Limitation of Liability.
This section applies to the Platforms and not to products sold online or by phone in one of our local or regional markets.
CERVEZA PICUDO tries to ensure that the information displayed is accurate and complete. However, CERVEZA PICUDO does not state or guarantee that CERVEZA PICUDO Material is accurate, free of errors or reliable, or that the use of CERVEZA PICUDO Material will not infringe the rights of third parties.
CERVEZA PICUDO does not guarantee that the functional and/or technical aspects of the Platforms or of CERVEZA PICUDO Material will be free of errors, or that the Platforms, CERVEZA PICUDO Material or the servers on which they are offered are free of viruses or other harmful elements. If the use of the Platforms or of CERVEZA PICUDO Material results in the need to repair or replace property, materials, equipment, data or other items, CERVEZA PICUDO will not be responsible for the corresponding costs. Without limiting the generality of the foregoing, everything offered on the Platforms is provided “AS IS” AND “AS AVAILABLE” AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, REASONABLE CARE AND SKILL, OR NON-INFRINGEMENT. CERVEZA PICUDO and its suppliers offer no warranties regarding CERVEZA PICUDO material, software, text, downloads, graphics and links, or regarding the results that may be obtained from using the Platforms.
To the extent permitted by applicable law, CERVEZA PICUDO will not be liable for indirect, incidental, objective or consequential damages arising from the use of the information available on the Platforms, or for loss of use, interruption of business, loss of profits or loss of data, whether in an action for contractual or non-contractual liability (including negligence) or of any other nature, even if CERVEZA PICUDO has been advised of the possibility of such damages.
Please note that in some jurisdictions consumer protection legislation may not allow certain exclusions or limitations of warranties or liability, so some of the above exclusions or limitations may not apply.
Trademark notice.
In general, all trademarks, logos and service marks (together, the “Marks”) shown on the Platforms are registered, unregistered or otherwise protected marks of CERVEZA PICUDO, or have been licensed to CERVEZA PICUDO by third parties. Other marks are the property of their respective owners and have been registered by them. Nothing contained on the Platforms should be interpreted as granting, implicitly or otherwise, licenses or rights to use any marks without the prior written consent of CERVEZA PICUDO or the corresponding third-party owner of the mark. Improper use of the marks shown on the Platforms or of any other content of the Platforms is strictly prohibited, except as provided in this document.
Intellectual property notice.
All content (including CERVEZA PICUDO Materials) on the Platforms is protected by the intellectual property rights of CERVEZA PICUDO or has been licensed to CERVEZA PICUDO. All rights reserved. See the section above on the Use of Materials on the Platforms.

The Platforms may include links to other platforms operated by third parties not related to CERVEZA PICUDO. The inclusion of links to those third-party websites does not imply that CERVEZA PICUDO recommends them. CERVEZA PICUDO has not reviewed all the content of the linked websites and is not responsible for the content or accuracy of any web pages outside the website or of any other websites with links to any of the Platforms. If you choose to click any link to access pages outside the website or third-party websites, you do so at your own risk. CERVEZA PICUDO does not authorize links to any of its Platforms from third-party platforms without its prior express written authorization.
Termination and suspension.
You agree that CERVEZA PICUDO may terminate or suspend your access to and use of the Platforms if CERVEZA PICUDO reasonably believes that the provisions of these Terms of Use have been breached, that there has been action contrary to their letter and spirit, or that the rights of CERVEZA PICUDO, its affiliated companies or any third parties have been infringed, regardless of any notice. You agree that CERVEZA PICUDO may modify or suspend the service of any of the Platforms, regardless of any notice. You agree that CERVEZA PICUDO will not be liable to you or to third parties as a result of such modification or suspension. The provisions titled “Limitation of Liability” and “General Provisions” will survive the termination of these Terms of Use.
General Provisions.
Unless otherwise stated, the information and materials of CERVEZA PICUDO shown on the Platforms are included solely for the purpose of promoting the products and services of CERVEZA PICUDO and, in certain cases, to present products for sale through various means. CERVEZA PICUDO makes no statements that CERVEZA PICUDO material is suitable or available for use in every country in the world. You will be responsible for complying with applicable local law, bearing in mind that access to CERVEZA PICUDO material may not be legal for certain persons or in certain countries. Our products are available in many parts of the world. However, the Platforms may show products that are not available worldwide.
If any provision of these Terms of Use or any part of it is declared illegal, invalid or unenforceable, the provision or part in question will be deemed excluded from these Terms of Use, and the legality, validity and enforceability of the rest of the provisions of these Terms of Use will not be affected, except by legal requirement.
These Terms of Use constitute the entire agreement between you and us regarding the use of the Platform and replace and revoke any previous agreements, draft agreements, commitments or ancillary contracts of any kind entered into by the parties, whether verbal or written, regarding their subject matter.
A waiver by CERVEZA PICUDO of a claim for breach of any provision of these Terms of Use shall not be interpreted as a waiver of claims for any other subsequent breaches.
Applicable law and jurisdiction.
These Terms of Use shall be governed by and interpreted in accordance with the law of Mexico, without reference to conflict-of-law provisions. Any dispute, controversy or claim arising from the Terms of Use, including in relation to their validity, invalidity, breach or termination, will be resolved judicially or through arbitration in accordance with their provisions. If the law of Mexico differs from the mandatory consumer protection regulations of your country, we will offer you a similar level of protection.
